Lámparas Escala© reaffirms its commitment to the data protection of its customers and visitors to this website. Therefore, to ensure compliance with the provisions of the General Data Protection Regulation (GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016), concerning the protection of individuals with regard to the processing of personal data and the free movement of such data, Lámparas Escala has reviewed the Terms and Conditions of use of its online store, as well as its Privacy Policy. The new wording of these texts will come into effect on May 25, 2018.

 

 

General Terms and Conditions of Use:

Access and navigation on this website are subject to these general terms and conditions of use, which are part of the General Sales Conditions of the online store www.lamparasescala.com and also the Privacy and Data Protection Policy presented by the company Alberto Escala López, located at C/ Baños nº66 and 68, Postal Code 41002, Seville, Spain, hereinafter referred to as Lámparas Escala©, in reference to the trademark it owns.

 

 

Introduction:

Sales made through the online store www.lamparasescala.com presuppose the customer’s acceptance of the General Sales Conditions established in accordance with the applicable legislation in the e-commerce sector in general.

Lámparas Escala reserves the right to modify these General Sales Conditions and will be required to publish any modifications on this website; The introduced modifications will not have retroactive effect.

Lámparas Escala is not responsible for events resulting from the unavailability of the website, regardless of its duration, and reserves the right to restrict access to certain areas of the website for technical reasons or to comply with legal obligations.

 

 

Concepts and Definitions:

Customer – any individual aged 18 or older who creates a customer account, committing to providing true and complete information regarding their identification and other necessary data for order processing. For all purposes, Lámparas Escala considers that a legal entity is identified and individualized by the connection between its social designation, registered office, and the legal entity identification number provided at the time of creating the customer account.

Cookie – a small file sent to the customer’s electronic device and stored on the hard drive. When creating an account on the website, the customer’s device will store a cookie that allows automatic identification upon return visits. If the customer does not accept the use of cookies, they will not be able to use this website.

Personal Data – information concerning an identified or identifiable natural person («the data subject»), directly or indirectly, especially by an identifier (such as a name, an identification number, email, internet protocol addresses, etc.).

Intellectual Property – all intellectual property rights to the software and content available through this website are owned by Lámparas Escala and are authorized and protected by global laws and treaties. All these rights are reserved for Lámparas Escala and its suppliers.

The customer may save, print, or display the content of this website for personal use only.

Publishing, manipulation, distribution, or reproduction of any content available on this website in any format, as well as its association with any business or company, is prohibited.

Lámparas Escala – a registered trademark owned by Alberto Escala López.

Data Processing – any operation or set of operations performed on personal data or sets of personal data, whether by automated or non-automated means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, communication by transmission, dissemination, or any other form of making data available, alignment or combination, restriction, erasure, or destruction.

 

Data Controller – Alberto Escala López, as identified above.

 

Customer Service – the support service, order management, and customer account of the online store, provided under the service agreement subscribed to by Lámparas Escala / Alberto Escala López, a sole proprietorship that is part of the same business group as the data controller.

Website – the website www.lamparasescala.com, operated by Lámparas Escala to promote and sell products from that online store. The security and operation of the website, as well as the computer processing of orders, are ensured by the company Alberto Escala López. The logistic management of sales is handled by DHL EXPRESS SPAIN SL CIF. B20861282. The financial management of operations is provided by Alberto Escala López.

Physical Address of the Commercial Establishment – the registered office of the company Lámparas Escala, located at C/ Baños nº66 and 68, Postal Code 41002, Seville, Spain, which is the address where the consumer should submit a written complaint.

 

 

Purpose:

These General Terms and Conditions of Use aim to establish the conditions of access and use of the website by customers who wish to make purchases in the online store. The General Sales Conditions aim to regulate the terms of operationalizing commercial transactions between Lámparas Escala and the Customer. The Privacy and Data Protection Policy aims to identify privacy protection measures related to the processing of personal data and the free movement of personal data, including tools for personalized data management provided by customers.

 

I – General Sales Conditions

 

1.1 Order and Purchase Process

The order and purchase process is only possible after creating a customer account and/or logging in to the online store. The customer must follow the various sequential steps of the order process, which will allow them to register the purchase.

 

Payment Terms and Methods

Once the order process is completed in the customer’s personal account, the purchase will be recorded, and the customer will have a deadline, indicated in the selected payment method, to proceed with the payment. At the end of this period, if there is no payment confirmation, the order will be canceled.

Some payment methods allow for saving the necessary data for conducting the payment transaction. However, in this context, no personal customer data will be retained, so such data management should be done directly with the service provider. An exception should be made for situations in which the service provider allows personal data management to be done directly on our website, in which case, as long as it complies with applicable legal provisions, the provider’s instructions, particularly regarding personal data protection, will be followed. In any case, data related to the customer’s payment information will not be retained unless the customer has given prior and explicit consent.

Lámparas Escala offers the following payment methods for purchases made through the online store:

 

Credit Card

The customer can make the payment with a credit card and take advantage of the liquidity and payment conditions offered by their bank.

All transactions on our website are secure.

Lámparas Escala uses a sophisticated fraud detection and prevention mechanism. Through this solution, it is possible to verify the authenticity of online payments, simultaneously ensuring the integrity and security of the customer’s data and their identification. This security is enabled by Secure Sockets Layer (SSL) technology, which encrypts these communications between the client’s software and our server so that the communications cannot be intercepted. Therefore, Lámparas Escala reserves the right to reject the payment of an order if the transaction is determined to be illicit. Any and all activities considered illegal will be immediately reported to the competent authorities.

 

 

3D Secure

3D Secure is a communication protocol designed to enhance the security of online payments and to allow the authentication of the credit card user by the card-issuing bank. After a payment in an online store, a process is activated to verify if the card used is valid. If the credit card is deemed valid, the security systems associated with the 3D Secure protocol verify the customer’s identity by contacting the card-issuing bank in real-time, which, in turn, validates the customer’s identity and issues confirmation that the card used is legitimate. This control is intended to protect credit card holders by reducing the likelihood of fraudulent use, ensuring a more effective transaction. This protocol is used by Visa under the name «Verified by Visa» and by MasterCard under the name «SecureCode.»

 

How is the credit card payment processed?

 

After selecting the credit card payment option and clicking «Buy,» the customer will be directed to the payment transaction page of the entity that guarantees the payment. On that page, the customer must provide the necessary credit card details, namely: the credit card number, expiration date, and the respective security code. In this sequence, the customer should click the «Make Payment» button.

If the payment is rejected, a message will be sent to the customer in the shopping cart window indicating the error encountered. In such a case, a new payment attempt is recommended. If the issue persists, it is advisable to contact the respective bank or credit card issuer for more information.

Once paid, the amount will be debited from the customer’s credit card account. If, for any reason, it is necessary to cancel the order, in whole or in part, the amount will be refunded within five business days. As a rule, the transaction will be reflected in the next bank statement, if a credit card was used, or directly in the customer’s account after three business days from the date it was made, if a debit card was used.

Note: Payments are always made in euros, even when prices are displayed in other currencies. Some banks may charge exchange fees. Lámparas Escala has no knowledge of this fact and, therefore, is not responsible for it.

 

Bank Transfer/Deposit

If the customer prefers not to pay for the order at the time of placing it, they can choose to make the payment later via bank transfer. We will only proceed with the order’s shipment once we have received confirmation from the bank that the transfer has been successfully made to our account.

It is advisable to include the order number in the comments of the bank transfer and to send proof of the transfer to our Customer Service.

Any additional fees charged by the bank will be the responsibility of the customer.

Products will be reserved for a period of 6 days. If Lámparas Escala does not receive payment for the order during that time, the order will be canceled.

 

Order Cancellation

 

The customer can only cancel the order before the respective payment and processing. If that is the case, they can do so by selecting the «Orders» option available in their customer account area. To do so, the customer must select the order they wish to cancel and click the «Cancel Order» button. Once the order is canceled, a message will appear requesting confirmation of this action.

Note: Order cancellation is only possible through the process mentioned above. Any requests made through other means will not be considered.

 

 

1.2. Delivery Process

 

To place an order, you should follow the online purchase procedure and click «Authorize Payment.» After this, the customer will receive an email acknowledging receipt of their corresponding order (the «Order Confirmation»), a tracking number, and a link that will allow them to track the order on the website of the selected courier service.

The customer can also access the tracking link sent to the provided email.

It is possible that when the customer receives the shipment confirmation with the corresponding tracking number, no results will be available. Updated tracking information on the courier company’s website may take up to 24 hours to become available from the time of order shipment confirmation.

Orders are delivered from Monday to Friday, excluding local or national holidays, to the address provided by the customer when placing the order. The delivery time for the item can range from 4 – 15 days (the timeframe may vary depending on the courier company).

 

Delivery Services

Lámparas Escala provides regular delivery services subject to the specific procedures of each courier company, particularly regarding shipping methods, delivery times, costs, and limitations associated with order requirements, as well as order validation mechanisms, recipient identity, or a third party representing the recipient. Lámparas Escala is not responsible for any changes in the conditions of the service provided by courier companies, solely responsible for ensuring that the procedures followed by them in the delivery process conform to the terms in effect at the time of the purchase. The specificity of some product segments may justify the establishment of a minimum purchase value, which will always be indicated in the first stage of the order process.

As such, the delivery options presented may vary depending on the type of products to be delivered, the destination geographic area, the desired delivery method (delivery to an address or a pickup point), or even the moment of validation of the selected payment method.

The expected delivery time, as well as relevant conditions or notes at the end of the order process, will be indicated as informational notes in each of the delivery options in the «Shipping Method» tab.

Note: Delivery times, counted from the actual shipping date of the order, are indicative, so they are considered valid only when there are no physical or structural impediments (e.g., incorrect addresses or force majeure, such as strikes, connection losses, weather, etc.).

The customer can, therefore, choose to receive the order at an address of their choice (excluding post office box deliveries). To do so, the customer only needs to provide an address where they will be present from 9 a.m. to 7 p.m. on the scheduled delivery day. A delivery attempt will be made by the courier of the selected courier service at the provided address.

It is not possible to choose a specific delivery time, as delivery will be subject to the courier’s route for that day, which is exclusively determined by the courier service.

Providing an incorrect or incomplete delivery address may result in the order being returned to Lámparas Escala, incurring additional costs for the customer. Therefore, it is strongly recommended that the customer always ensures that the delivery address provided at the time of ordering is correct and complete. Once the order is finalized, it is not possible to change this address or billing information.

If the customer chooses the delivery to a pickup point option, they will be subject to a time limit for pickup, which will not be less than 7 days, but will be determined solely by the selected courier company and communicated via SMS directly to the customer.

Warning: In any case, for service organization and courier distribution procedures, recipient identification data will be printed on a label placed outside the shipping box. Since these are the customer’s personal data, it is advisable to destroy or erase them after receiving the order to prevent these data from being accessed by third parties after discarding the packaging at recycling points.

 

 

Shipping Costs

 

The system automatically calculates shipping costs, which may vary according to the following circumstances:

– actual or volumetric weight (whichever is greater);
– total order amount;
– product segment*;
– courier company tariffs, subject to periodic updates.

Shipping costs are updated automatically as products are added to the shopping cart.

Due to the delicacy of certain products, shipping generally includes insurance coverage for damage during transport.

 

 

Refund of Shipping Costs

 

There are three situations in which a refund of shipping costs may apply:

i) Non-delivery of the order due to reasons attributable to Lámparas Escala or the courier service: the customer will be fully refunded for any amount paid for shipping. A member of the Returns and Refunds department of Lámparas Escala’s Customer Service will contact the customer to confirm the right to a refund and provide further clarification on this matter.

ii) Right of withdrawal from the contract: in accordance with articles 9 and 11 of Directive 2011/83/EU of the European Parliament and of the Council of 25 October 2011 on consumer rights, the customer can exercise their right to withdraw from the contract within 14 days from the day the customer, or a third party designated by them other than the courier, acquires physical possession of the ordered product or, if the order consists of several items to be delivered on different days, from the day the customer acquires physical possession of the last item delivered. To exercise this right, the customer must send Lámparas Escala an unequivocal statement of withdrawal from the contract using the electronic withdrawal form.

 

In this context, Lámparas Escala will fully refund the amount the customer paid for delivery, with the exception of:

 

a) any additional cost resulting from the choice of a delivery method other than the lowest-cost standard delivery method offered by Lámparas Escala;
b) any cost for returning the order as a result of exercising the right of withdrawal. In any case, the customer will bear the cost of returning the items to our warehouses.

 

The refund will be made as soon as possible and, in any case, within 14 days from the date the customer informed us of their intention to withdraw. We will make this refund using the same payment method employed by the customer for the initial transaction, unless the customer explicitly specifies a different refund method, providing clear payment details. The customer will not incur any fees as a result of the refund. However, we may withhold the refund until we have received the items.

 

 

Procedures for Incident Recording

In the event of a prepaid order* being returned to Lámparas Escala due to reasons attributable to Lámparas Escala, the total amount paid for the purchase, including shipping costs and return costs, will be refunded.

 

* Prepaid orders are those paid by credit card or bank transfer.

 

If the reason for unsuccessful delivery and the return of the order is the courier service’s responsibility, regardless of the chosen payment method, the customer must submit a written complaint that will be reviewed by the courier service. Alternatively, and subject to the customer’s express consent, this complaint can be sent to the courier service as a supporting document for the incident created due to non-delivery.

 

 

1.3. Return and Exchange Procedure

Returns and Right of Withdrawal

In addition to the conditions specifically provided in the previous section, the customer should also consider that if the product to be returned was purchased as part of a promotional campaign and, therefore, benefited from an offer with another product, both items must be returned. Both products must meet the return conditions mentioned earlier.

The customer has the right to withdraw from this contract within 14 natural days without the need for justification.

Only the return of a complete product pack will be possible. If the customer wishes to return a product that is part of a product pack, they must return all the products that make up that pack. All products must meet the return conditions mentioned earlier.

To exercise the right of withdrawal, the customer must notify us at Lámparas Escala, at the address, C/ Baños nº66 and 68. C.P. 41002, Sevilla, Spain, by phone at 954903632/664422221, through social media (Facebook and Instagram), or via WhatsApp, of their decision to withdraw from the contract through an unequivocal statement (e.g., a letter sent by postal mail or email). You may use the withdrawal form template attached to these Terms, although its use is not mandatory. To meet the withdrawal deadline, it is sufficient that the communication regarding the exercise of this right is sent before the corresponding deadline expires.

Notes: The absence of any element that prevents the product from being restocked for sale, in particular, the respective instruction manual in its original supply condition, results in its immediate classification as an incomplete product, and as such, its non-acceptance for return.

Each item(s) to be returned must be sent under the above-mentioned conditions, with the courier company’s label affixed to the original shipping box or an alternative that ensures the proper preservation of the product. This box should be destroyed once the condition of the returned product(s) has been confirmed. By failing to meet any of the preservation conditions mentioned above, the customer will lose the right to a refund, and in that case, they will have 10 days to collect the item(s) in question at our aforementioned location, bearing the costs of this process. This collection must be made by a courier company hired by the customer since in-person collection by individuals is not possible, even if the individual is the customer themselves.

 

 

Refund Methods

The refund will be made as soon as possible and, in any case, within 14 days from the date the customer notified us of their intention to withdraw.

If the payment was made by credit card, the refund will be made to the same card, and you will typically see it reflected in the next bank statement if you used a credit card, or directly in your account after three business days from the date it was made if you used a debit card.

If the payment was made by bank transfer, the customer will be asked to provide their bank account details for the respective refund.

 

 

Return Costs

 

Following the respective notification to Lámparas Escala and the confirmation that an error was made in the item(s) sent or that defective product(s) were sent to the customer, Lámparas Escala will bear the return costs by arranging for the collection of the item(s) at the delivery address. For this, a member of the Returns and Refunds department of Lámparas Escala’s Customer Service will contact the customer to arrange the collection and provide any further clarification on this matter.

 

 

1.4. Product Information

All procedures necessary to ensure that all product details, descriptions, and prices presented on the website comply with applicable laws are strictly followed. However, there may be situations where product information, including prices and promotional campaigns, has not been published correctly. In such cases, Lámparas Escala reserves the right not to process orders containing these products. If an order has been placed with such products, the Customer Service team will contact the customer to inform them of the inability to proceed with the order.

The inability to ship may also occur for other reasons, such as:

• Lack of stock;
• Failure to obtain payment authorization;
• Order considered fraudulent.

Note: As products may be subject to constraints or impediments in the country of delivery at any time, the customer should ensure that the purchased product complies with the applicable legislation in the territory of the delivery address, regardless of the possibility of being subject to customs or border control. If any restriction on the sale of a product is detected in advance, it will immediately be placed out of stock.

All products, campaigns, promotions, and offers are limited to available physical stock and/or the limited units set for each campaign.

Lámparas Escala also reserves the right not to allow the completion of the purchase process if any situation is detected, apart from those specifically described in this document, arising from a computer error in the creation of the order at any of its stages and associated with logistical problems, as well as the result of the knowledge or imposition by any competent authority of any restrictions on the sale of the products. To avoid this situation, we advise you to check the conformity of the product in question with the regulations applicable to the country of the delivery address.

Lámparas Escala may change prices without prior notice.

Payments are always made in euros, even when prices are displayed in other currencies. Some banks may charge exchange fees. Lámparas Escala is not responsible for this fact and will not assume any responsibility in this regard.

1.5. Conformity Warranty

 

Products are considered in conformity with the contract as long as they meet the description provided by Lámparas Escala and possess the qualities presented on this website, are fit for the usual purposes of products of the same type, and exhibit the usual quality and performance of a product of the same type that can be reasonably expected. In this sense, if any product is not in conformity with the contract, you should inform us through any of the provided communication channels.

The products we sell, especially handmade products, often exhibit the characteristics of the natural materials used in their manufacture. These characteristics, such as variations in color, texture, knots, and grain, shall not be considered defects. On the contrary, they should be anticipated and appreciated. We select only the highest quality products, but natural characteristics are unavoidable and should be accepted as part of the individual appearance of the product.

Since access to goods and services that correspond to the contracted ones and the guarantee of correct operation is a fundamental right of the consumer, Lámparas Escala will guarantee the quality of its products for a period of 24 months from the date of purchase, offering customers, when legitimate, one of the following solutions in the indicated order:

 

• Repair of the damaged item, ensuring its proper operation and/or final quality;
• Replacement of the item with an identical item;
• Replacement of the item with a similar item, concerning its characteristics and purpose, as agreed with the customer;
• Resolution of the contract and the consequent refund if none of the previous options is possible.

 

The exercise of the warranty right by the customer will always occur by filing a claim with Customer Service and returning the defective or non-conforming product.

Lámparas Escala will inspect the item to confirm the customer’s effective right to activate the warranty, excluding all situations that can be proven to be the cause, among others, of:

 

• Abuse, intentional damage, or negligence by the customer;
• Normal wear and tear of the product, as long as it falls within the expected levels and is declared by the manufacturer;
• Inability to prove the malfunction or defect indicated by the customer;
• All situations that are detected as an attempt at fraud.

 

After inspecting the received product, the customer will be informed of the respective decision. In cases where the warranty right can be exercised, Lámparas Escala will repair, replace, or refund the item as soon as possible, up to a maximum of 30 natural days counted from the notification sent by email to the customer, confirming the right to activate the product’s warranty.

The refund of any amount paid will be made using the same payment method used for the purchase, unless otherwise agreed with the customer.

These provisions are understood without prejudice to the consumer’s rights arising directly from the current law.

The duration of the legal warranty for second-hand items in Spain will be 12 months from the date of the invoice or purchase receipt or, in the absence of these, from the delivery note; for new items, the duration of the legal warranty will be 24 months.

 

 

1.6. Suggestions and Complaints

 

Customer feedback is very important to Lámparas Escala as it allows for improvements in the services provided. Therefore, if for any reason, customers are not satisfied with our services or with any of the products purchased, or even if they have any suggestions, Lámparas Escala appreciates communication within 14 days from the receipt of the order by the recipient or a third party designated by the recipient, through any of the contact channels with Customer Service.

If the customer has received a defective or damaged product, or if the received product is different from what the customer actually purchased, they will need to attach a video to the claim or, as the case may be, photographs in which both the reported problem and the condition of the box in which we delivered the order are clearly visible.

The customer should also keep, until otherwise instructed by Customer Service, not only the defective, damaged, or non-conforming product but also the respective cardboard delivery box.

 

 

1.7. Alternative Dispute Resolution

 

In case of conflict, the consumer can consult the Online Dispute Resolution entities identified on the website: https://webgate.ec.europa.eu/odr.

2.2. Types of Personal Data Collected

 

In general terms, personal data is collected in three situations arising directly from Lamparas Escala’s activities:

 

 

2.2.1. User Registration: Creating Lamparas Escala Customer Accounts and Data Processing Purposes

 

To create a customer account, a personal area is provided where the customer must enter the necessary data for their identification as a customer. The completion of the first purchase depends on providing additional personal data that is essential for order processing and delivery.

Mandatory fields in the forms available for these registration stages are marked with an asterisk (*).

Lamparas Escala commits to protecting customer data and will not make it available to third parties without the recognition or consent of the data subject, as legally required.

Additionally, when making a purchase on the website, customers will also be asked for their shipping address and payment details to promote maximum efficiency and ensure that delivery deadlines are met. This data will be transmitted to the aforementioned group companies as well as the courier responsible for order delivery, all of whom are obligated to process this data in strict compliance with the principles of the GDPR regarding personal data protection.

When processing a customer’s order, certain personal data, such as the address and postal code, may be disclosed to third parties solely for the purpose of preventing and detecting fraud and always in response to requests from competent authorities. These entities must also implement protection and security measures for such data.

 

Warning: For the sake of personal data security and protection, it is advised to destroy or remove the label on which the data is printed immediately after receiving the order to prevent third parties from accessing this information after discarding the packaging in recycling points.

 

For the effectiveness of other functionalities provided by Lamparas Escala at the customer’s request, additional data may be requested. These data will be subject to processing in accordance with the specifically established terms and conditions available for each functionality.

The provided data will be stored for the strictly necessary period, which generally corresponds to the existence of the customer’s account. Therefore, when a customer chooses to deactivate their account, personal data will be permanently deleted, except for data required to fulfill legal obligations, such as billing and accounting. These data will be stored in a dedicated, anonymized database, created for this purpose, and only for as long as absolutely necessary for these purposes. Data related to transactions carried out during this period using credit card payment will also be stored in this anonymized database for a period of twelve months. This storage is done solely for processing refunds that may be due to the customer during this period, counted from the date of issuance of the respective invoices.

As such, once an account has been deactivated, if a customer wishes to place a new order on this website, they will need to create a new registration, subject to the terms and conditions in effect on that date.

What are the collected data used for?

To ensure that the contact is truly initiated by the account holder, Lamparas Escala has implemented measures to reinforce the caller’s identity confirmation, especially in cases where contact is made by phone.

In this context, the customer may be asked, for example, to provide one or more products purchased in previous orders, which the operator will do after requesting permission to access the purchase history from the last 6 (six) months. Alternatively, and after describing the identity validation mechanism, the operator may send an alphanumeric validation code to the customer’s contact phone or email address registered on the customer’s account, which will be required by the operator at the beginning of the conversation.

Once the customer’s identity has been validated, the operator will ask key questions based on the description of the contact’s purpose to frame the situation and possibly refer it to the specialized Customer Service member for the subject to be addressed.

The recording of the call for the purpose of evaluating service quality will depend on the customer’s prior and express consent for this purpose.

 

 

2.2.3. Lamparas Escala’s Contact with the Customer

 

When processing a specific order, it may be necessary for Lamparas Escala’s Customer Service to contact the customer for:

 

i) confirmation or rectification of any personal data necessary to complete the delivery process (e.g., the delivery address). In such cases, contact will be made to the phone number registered in the customer’s profile. Once the connection is established, the operator will confirm the identity of the caller by following, if necessary, the procedure described in clause 2.2.2. above.

 

ii) informing the customer that a message has been sent to the customer’s Lamparas Escala account mailbox due to the lack of stock of one or more items in the order in question, and that, as an alternative to the lack of stock, a refund of the amount paid or a replacement with similar products may be made, as provided in clause 1.4. of the General Sales Conditions.

 

iii) requesting further information about the content of any message sent by the customer or ongoing conversations. In both cases, after this contact, there will be a written message confirming the addressed content and/or any agreements reached.

This amount must be settled within five business days after receiving the payment instructions, which will be sent in writing to the email address provided by the data subject and/or via SMS to the phone registered on their account or provided in response to such a request.
